These Terms of Service ("Terms") govern your use of the SureHome website at www.surehome.in(the "Site") and your purchase of products from SureHome ("we," "our," or "us"). By accessing or using our Site and placing orders, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Site. These Terms are governed by the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.

1. Account Registration

• You may browse our Site without creating an account. However, an account is required to place orders and access certain features.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must provide accurate, current, and complete information during registration.
• You must be at least 18 years old to create an account and place orders on our Site.
• We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

2. Products and Pricing

• All product descriptions, images, and specifications on our Site are provided for informational purposes. We make every effort to display colours and features accurately, but actual products may vary slightly due to screen settings, lighting, or manufacturing variations.
• All prices are displayed in Indian Rupees (₹) and include applicable taxes (GST) unless stated otherwise.
• We reserve the right to modify prices at any time without prior notice. The price applicable to your order will be the price at the time of order placement.
• In case of a pricing error, we reserve the right to cancel the order and issue a full refund. We will notify you of such cancellation.
• Discount codes and coupons are subject to terms specified with each offer and may not be combined unless explicitly stated.

3. Order Acceptance and Processing

• Placing an order on our Site constitutes an offer to purchase. All orders are subject to acceptance and availability.
• We will send an order confirmation via email and WhatsApp upon successful order placement. This confirmation does not guarantee final acceptance — we reserve the right to decline any order.
• We may cancel or refuse orders for reasons including but not limited to: product unavailability, pricing errors, suspected fraud, or violation of these Terms.
• Order modifications or cancellations can be requested within 2 hours of placement by contacting us on WhatsApp or email. After this window, the order enters processing and changes may not be possible.
• In the event of order cancellation by us, a full refund will be issued to your original payment method within 5-7 business days.

4. Payment Terms

• We accept the following payment methods: UPI (Google Pay, PhonePe, Paytm), credit cards, debit cards, net banking, and Cash on Delivery (COD).
• All online payments are processed through Razorpay Payment Gateway, which is PCI DSS Level 1 compliant. We do not store your payment card details on our servers.
• COD orders have a maximum order value limit of ₹5,000. We reserve the right to refuse COD for certain pin codes or repeat COD-defaulting customers.
• Payment must be received in full before an order is processed (except for COD orders).
• Failed payments will not result in any charges. You may retry the payment or use a different payment method.

5. Shipping and Delivery

• We ship to all serviceable pin codes across India. Delivery typically takes 5-7 business days for metro cities and 7-10 business days for other locations, depending on the courier partner and your location.
• Free Shipping: Orders above ₹499 qualify for free standard shipping. Orders below ₹499 will incur a flat shipping charge of ₹49.
• Shipping timelines are estimates and not guaranteed. Delays may occur due to unforeseen circumstances such as natural disasters, courier strikes, or high-demand periods (festive seasons).
• Risk of loss and title for items purchased pass to you upon delivery of the items to the courier partner.
• We are not responsible for delays caused by incorrect or incomplete shipping addresses provided by the customer.
• Tracking information will be shared via WhatsApp and email once the order is dispatched.

6. Returns and Refunds

Returns are governed by our Return Policy. By placing an order, you agree to the return terms outlined therein. Key points:

• Returns must be initiated within 7 days of delivery.
• Products must be unused, in original condition with all tags and packaging intact.
• Certain categories of products (personalised items, perishables, intimate items, gift cards) are non-returnable.
• Refunds are processed within 5-7 business days after the returned product is received and inspected.

7. Intellectual Property

All content on the SureHome website — including but not limited to text, graphics, logos, images, product descriptions, icons, audio clips, software, and the overall design — is the property of SureHome or its content suppliers and is protected by Indian and international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from our Site without prior written permission from SureHome. The SureHome name, logo, and all related marks are trademarks of SureHome and may not be used without our consent.

8. Prohibited Activities

You agree not to engage in any of the following activities:

• Using the Site for any unlawful purpose
• Attempting to gain unauthorised access to our systems or other users' accounts
• Interfering with or disrupting the Site's functionality or servers
• Placing fraudulent orders or using stolen payment information
• Scraping, crawling, or extracting data from our Site without permission
• Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
• Using automated systems (bots, scrapers) to access the Site

9. Limitation of Liability

To the maximum extent permitted by applicable Indian law:

• SureHome shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or purchase of products.
• Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to SureHome for the specific product or service giving rise to the claim.
• We are not responsible for any delays, losses, or damages caused by events beyond our reasonable control (force majeure), including natural disasters, pandemics, government actions, courier disruptions, or internet outages.
• We do not warrant that the Site will be available at all times, error-free, or free of viruses or other harmful components.
• Product warranties, if any, are limited to the manufacturer 's warranty and do not extend beyond it.

10. Indemnification

You agree to indemnify, defend, and hold harmless SureHome, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of the Site; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Site.

11. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Site shall be resolved as follows:

• We encourage you to first contact us at support@surehome.in to resolve any issues informally.
• If the dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.
• These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

12. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective upon posting on this page with an updated "Last updated" date. Your continued use of our Site after any modifications constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically for any changes.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
